A separate quote, work order, project agreement, invoice, warranty document, or other written agreement may apply to services provided by Hanks. If a project-specific agreement conflicts with these Terms, the project-specific agreement controls for that project.

1. Eligibility and Authority

You must be at least 18 years old and able to enter into a binding agreement to use the website to request services. If you submit information for a property, business, organization, or another person, you represent that you have authority to do so and to authorize access to the property as needed.

2. Website Information

The website provides general information about Hanks, our service categories, project examples, service areas, promotions, and educational topics. Website content is provided for general informational purposes and may not describe every condition, limitation, code requirement, material, or method relevant to a particular property or project.

Images, galleries, reviews, examples, and descriptions illustrate prior work or general capabilities. Results vary based on existing conditions, materials, scope, maintenance, customer selections, and other project-specific factors. Nothing on the website guarantees that identical results, pricing, timing, or availability will apply to your project.

3. Requests, Quotes, and Service Agreements

Submitting a website form, calling, texting, emailing, or requesting a quote does not by itself create an appointment, service contract, or obligation for Hanks to perform work. A request is accepted only when Hanks confirms it. Service availability may depend on location, scope, scheduling, staffing, materials, access, safety, weather, permits, and other factors.

Quotes are based on the information reasonably available when prepared. A quoted price covers the agreed scope described in the applicable quote or project documentation. Hidden damage, concealed conditions, inaccurate or incomplete information, code or permit requirements, unavailable materials, customer-requested changes, or other conditions outside the agreed scope may affect price or timing. When practicable, Hanks will explain material changes and request approval before proceeding with additional work.

Online descriptions, promotions, or preliminary conversations are not a substitute for the final written scope. Pricing, deposits, payment schedules, cancellation terms, start dates, completion estimates, materials, exclusions, and other project terms will be stated in the applicable project documentation.

4. Scheduling and Communications

Appointment times and project schedules are estimates unless expressly confirmed otherwise in writing. Timing may change due to weather, traffic, emergencies, customer changes, site conditions, material availability, permit or inspection timing, illness, or other circumstances. We will use reasonable efforts to communicate material scheduling changes.

By providing your phone number or email address, you authorize Hanks to contact you about your inquiry, quote, appointment, project, warranty, or related services by phone, text message, or email. Standard message and data rates may apply. You are responsible for providing accurate contact information and promptly updating it if it changes.

5. Customer Responsibilities

You agree to:

  • provide accurate and complete information about the property, requested work, known hazards, prior damage, and relevant conditions;
  • obtain any necessary authorization from the property owner, landlord, association, or other responsible party;
  • provide safe, reasonable, and timely access to the work area, utilities, and property as agreed;
  • secure pets, valuables, fragile items, and personal belongings near the work area;
  • identify known utility lines, alarm systems, hazardous materials, structural concerns, or other risks that may affect the work;
  • make selections, approvals, and payments according to the applicable project documentation; and
  • use completed work and installed products according to applicable instructions and maintain them appropriately.

Failure to satisfy these responsibilities may result in delay, rescheduling, additional charges where permitted by the project agreement, or refusal to begin or continue unsafe or unauthorized work.

6. Materials, Permits, and Trade Requirements

Hanks may help customers evaluate practical material and project options. Final selections remain subject to availability, manufacturer terms, suitability for the intended use, and the applicable project agreement. Product colors, textures, dimensions, and finishes may vary from online images or samples.

Permit, inspection, licensing, and trade-specific requirements vary by jurisdiction and scope. Responsibilities for permits, inspections, specialty trades, engineering, design, and related costs will be addressed in the applicable project documentation when relevant.

7. Hanks Home Guarantee and Other Warranties

The Hanks Home Guarantee reflects our commitment to reliable service, clear communication, skilled workmanship, and completing the agreed scope. Coverage varies by service, project type, materials, products, and other conditions. The warranty or guarantee terms that apply to a project, including coverage periods, exclusions, customer responsibilities, and claim procedures, will be described in the applicable project documentation.

Manufacturer warranties, when available, are provided by the manufacturer and are subject to the manufacturer’s terms. Website statements do not expand or replace the written warranty or guarantee applicable to a specific project.

8. Promotions and Special Offers

Promotions, coupons, discounts, and special offers are subject to the terms displayed with the offer, including any expiration date, service-area restriction, qualifying service, minimum purchase, availability, or exclusion. Offers may not be combined unless expressly stated. Hanks may modify or discontinue an offer as permitted by law, but changes will not alter an offer already incorporated into an accepted written project agreement.

You retain ownership of photographs, documents, project descriptions, feedback, and other content you submit. You grant Hanks a nonexclusive, worldwide, royalty-free license to receive, store, reproduce, and use submitted content as reasonably necessary to evaluate your request, prepare a quote, communicate with you, perform and document services, maintain business records, resolve disputes, and comply with law.

You represent that you have the right to submit the content and that it does not violate another person’s privacy, intellectual property, or other rights. Do not upload malicious files or unnecessary sensitive information. Hanks will not use identifiable customer project content for advertising or portfolio purposes without permission or another lawful basis.

If you voluntarily submit a review, testimonial, or other content for publication, you authorize Hanks to display, reproduce, and format that submission in connection with our business, subject to applicable law and any separate agreement.

10. Intellectual Property

The website and its text, graphics, logos, designs, photographs, videos, software, arrangement, and other content are owned by or licensed to Hanks and are protected by intellectual property laws. You may view and print reasonable portions for personal, noncommercial use. You may not copy, republish, sell, modify, scrape, frame, distribute, create derivative works from, or commercially exploit website content without prior written permission, except as allowed by law.

General website and educational content is not architectural, engineering, legal, code-compliance, safety, or other professional advice and should not be relied upon as a substitute for project-specific evaluation.

Nothing in these Terms excludes or limits an express written warranty, the Hanks Home Guarantee as stated in applicable project documentation, or any right or remedy that cannot lawfully be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Hanks and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the website or reliance on general website content.

Liability relating to actual handyman, remodeling, maintenance, installation, or other services is governed by the applicable project agreement and law. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Hanks and its owners, officers, employees, and service providers from third-party claims, damages, and reasonable expenses arising from your unlawful misuse of the website, your violation of these Terms, or content you submit in violation of another person’s rights. This section does not require you to indemnify a party for that party’s own negligence or misconduct where prohibited by law.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing a lawsuit concerning the website, the parties agree to make a good-faith effort to resolve the dispute informally by providing written notice and a reasonable opportunity to respond. If a dispute cannot be resolved, it may be brought in a court of competent jurisdiction in Texas, subject to applicable law and any controlling project agreement.

A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable project-specific agreement, constitute the relevant agreement between you and Hanks regarding their respective subject matter.
